DHS – HSI S/A Hector Fuerta (spelling not clear) has been with HSI for 3 years in Deming. He was involved in the New Deal sting operation on June 15, 2011. His task was to provide back-up cover inside the store for Cooperating Defendant (“C/D”) Jose Roman and the Undercover (“U/C”) agent for their safety.
He stated he entered the store around 1:25 – 1:30 and stated he was inside the store 10-15 minutes.
He observed the C/D and U/C talking to Ryin. Terri approached him to see if he needed any assistance, but stated her attention was not on him, she was more interested in the conversation Ryin and the U/C were having because she was looking their way instead of at him. She asked Remington to assist him, and she went to help Ryin.
He testified he stayed long enough to make sure the U/C and C/D were okay, and as soon as they left he stayed 2-3 minutes longer talking to Remington. He testified he saw Terri, Rick and Ryin talking behind the counter, standing 1′ – 3′ apart from each other other. He testified he wasn’t close enough to hear what they were talking about. He stated they “huddled” together, and they were not bowing their heads and not holding hands. He characterized the speech as “whispering”.
He stated he saw the 50 caliber gun on the counter, but only briefly.
Under cross examination, other customers were in the store and another back-up officer was in the store, and another employee. He couldn’t hear what they were saying because they were 15-20 feet away. He doesn’t recall if there was music playing.
The Judge asked if when he left when the Reese’s were “whispering” if Remington was with them. He stated Rem was not with them.
He stated the June 15th sting was right after lunch around noon.
When asked if the reason Terri might have been more interested in the sale that Ryin was involved with was because it was a $4200 transaction and his potential sale was about a $400 transaction, Huerta stated he guessed so. But he added that if they wanted to make a sale they would have paid attention to him.
