So the prosecutor would attempt to win the case by willfully suppressing evidence? That would get the first conviction tossed out pretty quickly.

If that evidence was generated prior to the shooting based on witness reports would that help or hurt the gun banners (libs) case?

As an example which is not necessarily this case, would it make sense to sell someone guns who is being treated for schizophrenia? The common sense argument for that extreme case is 'no', to me at least(I know people that are). They certainly would be rejected for a government clearance.
