Madison - Racine Republican Sen. Van Wanggaard can continue raising unlimited campaign funds if he chooses to seek a lawsuit challenging his loss in the June 5 recall, the state Government Accountability Board said Monday.
Wanggaard told WTMJ-AM (620) radio host Charlie Sykes on Monday that challenging the results would cost between $100,000 and $200,000. That money would come from the senator's campaign fund, according to accountability board staff counsel Michael Haas.
A quirk in election law that allows elected officials to raise unlimited funds in the event of a recount would still be in place should Wanggaard seek a lawsuit, Haas said. The recount, initiated by Wanggaard, affirmed Democrat John Lehman's win by 819 votes.
If Wanggaard initiates legal action, the accountability board cannot certify election results until the court rules on the case, meaning unlimited fundraising remains in place and Lehman cannot be sworn in. Republicans hold a 17-16 Senate majority, but control would shift to Democrats when Lehman is sworn in.
Wanggaard has until the end of the day Tuesday to decide whether to challenge or concede. He told Sykes he has not yet decided.
Wanggaard called the number of elections issues his campaign identified "mind-boggling," including poll workers accepting illegitimate proof of residency for same-day registration and reports of election clerks ignoring Republican poll watchers' challenges. The Racine County election clerk could not confirm the allegations, but said they are concerning. The City of Racine's municipal clerk, who handles polling place staffing and training, was unavailable for comment.

He should sue. The Democrats cheated to get the clown, Al Franken, elected to the Senate in Minnesota by numerous fraudulent recounts, and that was fine with the media.

Sue. The Republicans need to fight as hard as the Democrats. This is war. Fight for all the marbles. Even the delay prevents the Dems from taking control of the Senate. Drag it out until the next election.

Unfortunately, I only have 5 days from the end of the recount to develop a case to challenge the count of the election. This is not enough time to fully investigate the mountains of evidence and answer the questions that have arisen. This is especially true given the surprising lack of cooperation we have received from city officials in our requests. The investigation into irregularities does not stop today. The investigation will continue and evidence discovered will be provided to law enforcement.
The seemingly never-ending delay by Dane County judges preventing implementation of Wisconsins voter ID law undoubtedly played a role in this recall election. Even if I were to challenge and win in Racine County court, an appeal to that challenge would be heard in the Madisons Court of Appeals. A challenge would also be extremely costly to taxpayers, who have already been forced to waste $20 million on the recall election.
Despite pleas from around the state to challenge the election, it is not in the best interests of Racine, or Wisconsin, at this time. Now is the time to focus on gaining the state senate back in November, winning Wisconsins U.S. Senate seat, and electing Governor Romney as President.
The count of the ballots those cast appropriately and those that may not have been - shows my opponent with more votes. I hope John Lehman learned the lesson of his defeat in 2010, and pursues a more job-friendly agenda in office.
As for me, I have spent my entire adult life in service to our community. The June election will not stop that dedication to service. I will be a candidate for the 21st Senate District at the next election. As General Douglas MacArthur once said, I shall return.

I’m listening to Wanggaard on Jeff Wagner (WTMJ 620) right now. He said that there was a lot of smoke, but no gun. He’s listing the irregularities right now.
On WISN this afternoon I heard during a newsbreak, that Van has conceded.

He should sue. He will get millions in donations for that cause.
We can start getting recall signatures on the illegitimate “winner” starting July 31, 2013.

He’s going to run at the next election and use his time in the interim to expose voter fraud.

I read in the Milw. JS on Sunday that there is already a movement to start a recall on the fraudulent winner of the recall. It said they could start July of 2013, a year after this recall. I hope they do.
I am glad to read that Van will devote his time to expose the outrageous fraud here in WI.
The so-called judge who is stopping our Voter ID Law should be tarred and feathered and booted off the bench. Yet he knows that instead, nothing at all will happen to him.
I don’t think that seat is up until 2014.
Oh no. We can’t have that seat occupied by a cheater that long. I do hope there is a recall started on that guy.
