The SCOTUS punted based on politics trumping the Constitution. Who knows what the rules are now?
Do the GOP have the balls to do it?? I know Demint, Toomey, Johnson, Lee, and Rubio have them. Does Romney have the spine to sign it?
Actually, they didn't. They said it was not a tax for the purposes of the Anti-Injunction Act, but it was "enough like a tax" to confer on Congress the power to pass it.
Since this "like a tax" non-tax is not an enumerated power of Congress, there is going to be constant litigation and appeals until the whole mess is repealed.
But your constant chanting of "it's a tax" does not change the reality that it is:
Not an excise
Not an impost
Not a duty
Not apportioned among the several States
and not a tax on incomes
So, it is most certainly not a "tax" that Congress has any authority to pass.
