The coastal town of Depoe Bay is about to experience its quietest July 3 in 19 years.
Town officials this year reluctantly announced they were cancelling the annual pre-Independence Day fireworks show, following pressure from federal wildlife managers who said the noise disrupts protected sea birds.
he shows ran smoothly for two decades.
Then, in 2010, a Depoe Bay resident contacted the federal wildlife service and reported seeing seabirds nesting at Pirates Cove take flight during the fireworks.
The federal agency asked the city to consider moving the fireworks to Fogarty Creek State Recreation Area, a little farther north. But organizers responded that moving the show farther away was not an option.
Seeking more tangible proof of disturbance, Taunton and other Depoe Bay leaders asked the fish and wildlife service to conduct a study at the site.
Federal officials agreed. So, as organizers prepared for last year's fireworks show, fish and wildlife officials positioned themselves in Pirates Cove.
Chuck, the federal wildlife manager, said staffers used aerial photography, video footage and the naked eye to see how seabirds at the cove reacted to the boom of the fireworks. The study showed the nearby explosions had an impact. Seabirds were frightened away from nests by the noise, and returned to find that eggs had been damaged or eaten by predators, she said.
"We did document disturbance, including nests that were lost," Chuck said.
But because the location where the fireworks are launched is on state park land, state officials were warned they could be liable for violating the 1918 Migratory Bird Treaty Act, a federal law that makes it illegal to harm or kill protected bird species.

So WTF happens to the birds during a loud and lengthy thunder storm?
“So WTF happens to the birds during a loud and lengthy thunder storm”?
All thunder storms have also been cancelled
Good question!
So in order to protect the US from invasion from space aliens or other foreign aggressors - we place endangered bird species along our borders and enforce some 1918 act????
I love to see stories like this — makes me so happy that I grew up as a kid in the 70’s where cap guns looked real - and toys were made of metal - and GI Joe had real looking accessories - and if you did something stupid - you took responsibility - and never blamed someone else - and competition meant something...now because some birds took flight because 1 night there were some fireworks and a few eggs were eaten - that community can’t celebrate 4th of July!
Is that the only place birds nest???
When I go out my front door, the birds often take flight as well.
So...
The Audubon Society got the Radar installation on Diamond Head shut down on December 7, 1941. That worked out well.

Those species who can't adapt, will be replaced.
LMAO, thanks.
Shhhh!!!! Bomb quietly or you'll wake up Joe Bide, from his nap.
It is not state land, it is not federal land, it is OUR land that supposedly is being held in trust for us. And when federal officials try to yell ‘get off my lawn’, we should take a page from the punks who live down the street, raise the appropriate finger, and do it anyway.
The appropriate response should be: “We are quite surprised that Federal officials have decided to take this stance, especially in regards to 4th of July fireworks, or in our case, pre-holiday fireworks. Since it is a day in remembrance in standing up and overcoming tyranny, we have decided to add 9 minutes to our program, and will include a set piece of a hand for federal officials who might be observing to enjoy. Parents are advised to keep their children from the Pirate’s Cove viewing locations.”
Funny that the noise never disrupted the sea birds prior to Barry and the ‘RATS taking total control of the country. Maybe that’s what is really “disrupting” them.
Fun-sucking, anti-American Nazi scumbag federal wildlife MORONS should be ignored completely. This is beyond insane and defies logic....a five-year-old could call BS on this one.
I believe the Law of Eminent Domain says quite the opposite.
Our Federal Government is a corporation registered in Washington, D.C., which is not a part of the United States. That corporation owns the United States.
Windmills are killing more birds than fireworks.
And probably as likely to be made in China.
My great aunt use to light firecrackers and throw them at Starlings nesting in the sugar maple trees when I was a kid in the 70s. It did nothing to scare the birds. I figure they just stared at her, gave her the middle feather, then went back to squawking :-)
