A Franklin homeowner who fired a gun at a stranger pounding on his living room window acted reasonably and won't face any charges, according to the Milwaukee County district attorneys office.
Franklin police had referred the matter to the district attorney as a possible case of second degree reckless endangering safety. But after meeting with the homeowner Tuesday, prosecutors decided not to issue any charges.
"The evidence showed that the homeowner repeatedly warned the intruder to leave his property, and informed the intruder that he had a gun," Chief Deputy District Attorney Kent Lovern said.
"Although he fired his gun, he did so expressly not to harm the intruder, and in fact did not harm him. Under the circumstances, the homeowner's actions were not unreasonable and therefore, not criminal in nature."
According to police records, Charles Bucci told police he heard a man talking in his front yard in the 8200 block of S. 100th St. about 9:15 p.m. June 21. Bucci got out of bed and grabbed his handgun, went to his living room and opened the bay window shade to see a man standing right at the glass.
Bucci, 58, asked "What do you want?" and the man, identified as Anthony Jerzak, 34, of Milwaukee, began pounding on the window and saying he wanted to come in. Bucci told Jerzak to back away, and let him know he had a gun, but Jerzak kept banging on the window.

A prosecutor with some common sense. Not sure about these police. The state is getting stranger and stranger.
I’m glad the homeowner isn’t going to face charges. IMHO, he’d be justified even if he’d shot the guy instead of firing a warning shot. Telling someone you are armed and then giving the intruder a chance to leave your property seems ample warning in itself. Ample warning that something very bad is going to happen if they continue their present course of action!
I wonder why this is not a huge deal in the MSM?
For this situation call 911 and let them know the situation. At the same time wait silently under the cover of darkness for the intruder to come through uninvited. When he does just apply some Chicago Lightning (in the Mozambique style) to his lead prescription.
While you are waiting for the cops to show up call your lawyer, give a very brief statement as to what happened, and let them take out the trash.
No arguments. No warning shots. No repeat offender.
Screwed up a perfectly good window at his own expense for no good reason. Should have waited till the perp broke it and then blown his head off
He then breaks a window and stand there yelling.
The deputy arrives and arrest the young man for criminal damage to property and DC. on the way to the jail the young man keeps repeating he shot at me he shot at me.
After getting him booked and locked up the deputy goes back out to the house and talks with the home owner. And asked if he shot at the young man the home owner says naw I took my 44 mag a ruger black hawk and fire in the air near him.
The muzzle blast alone along side of the young mans head was enough to stop his actions.
Some how that fact was never mentioned in the reports and the young man was convicted of above crimes.
He was so high he didn't remember what happen when he woke up in jail the next morning.
Things were simpler in rural Wis 30 plus years ago.
Hey. I would have told him I was opening the door but should he cross your threshold you were going to shoot him. Then when he was far enough into the room that he would fall “inside” you are clear.
