That’s not a bad approach. I woke my poor husband up at 6:15am with “they struck it down!!” - only to sheepishly return a bit later with “no they didn’t.” At that moment I did think Roberts was as big a dog as most of the posters today...

But you have to let reason in, and ask yourself “why the hell would he have done that?” - and calling him some yellow belly communist, as some here have done, is immature and intellectually shallow. John Roberts is NOT a liberal. He may not be as conservative as some of us hoped/thought, but he has been a very solid conservative vote on the court. You can’t argue with that just because he’s not voted with Scalia 100% of the time. He’s not some social liberal either. There is an explanation out there for why he ruled as he did, we just aren’t sure of it yet.

Ah except the know it all name callers, who in fact surely must have his number already.

And for those pining away for Harriet Miers, refer to the intellectually shallow comment above.

Pretty simple. It would have been a 5-4 decision reversing the biggest progressive coup of the last century. Even more controversial than Bush v. Gore. Roberts cares more about the prestige of the Court than he does about the Constitution. The Court’s prestige is not unimportant; but if it punts every time things get rough, judicial review is meaningless.

Maybe Justice Roberts is playing chess, and everybody else is playing checkers. If Obama gets re-elected he could appoint as many as 3 more Supreme Court Justices, which would totally devastate the court for years to come. By doing what he did, two thirds of the voters who are opposed to Obamacare will be energized for the November election, thus virtually guaranteeing Obama’s defeat. Roberts may have put the final nail in the coffin for Obama’s re-election chances.
