Yes, in the event of a tie vote at the Supreme Court, the decision of the Appeals Court stands as binding on the parties involved, but the decision is not counted as a binding Supreme Court precedent. (You actually have to have a majority SCOTUS decision to create a binding national precedent on the lower courts.)
