The Individual Mandate was voted 5-4 but it did not apply since Roberts agreed with the SCOTUS liberal wing that the penalty amounted to a tax. Since it is read as a tax, the Commerce Clause does not apply.

The ACA should never, never have been passed. The SCOTUS ruling will have the (un) intended consequence of punting the whole issue back to the legislature for repeal.
