You are absolutely right. But my guess is that the McCain et al. will not go after it. My question about the opinion is how the penalty cannot be called a direct tax and therefore apportioned among the states according to lpopulation.
He laid the groundwork for Obama. That is beyond debate now.
I’m no Kathleen Parker fan but she was right that critics were trying to get under Roberts’ skin and I quote,
“Publicly chastising the court and now taunting Roberts specifically seems to have two purposes. One is to get under Robertss skin in the hopes that hell rule the correct, if not necessarily legally correct, way. Two is to lay the groundwork for declaring the court illegitimate if all or part of Obamacare is overturned.
Either way, its politics at its filthiest and is beneath the dignity of the court and of the White House. Unfortunately for Roberts, its up to the chief justice to hold the bar high.”
Unfortunately, it looks like they succeeded.

Sorry, but that is almost as unlikely to happen as the SCOTUS actually upholding the CONSTITUTION. Ovomit has been given new life and will trumpet this to the nth degree as proof that he was “right” and all his mindless minions who suck the life out of those of us who actually work and pay taxes will keep their sorry asses in office just to make sure the teets are available for them to keep sucking on.
To think the GOP will do anything but roll over is wishful thinking. Romney and the rest will feign outrage, promise to “overturn” it IF they win in November and that will be it. IF they are lucky enough to win the WH and put both the Senate and House in the GOP control, they won’t do squat. The dems will filibuster, scream bloody murder and use their MSM lapdogs to paint the GOP as evil tyrants and the GOP will roll over.
Plain and simple. And you can bet that once this is in place, NO ONE will have the balls to ever try and touch it. Just like Social Security, it will be the “third rail” of every political debate that NO ONE will go anywhere near.

I’ll add that to me right now Roberts seems to have been swayed by a preoccupation with his own legacy, rather than doing the right thing for our country.

My only comment would be to add 5 more names.
Well now that it is a tax it can be “adjusted” for the needy by increasing the earned income tax credit. Just became another avenue for another massive redistribution of wealth.
His legacy will be the "Roberts Tax." Some legacy.
Time to file bankruptcy to get rid of our debts so we can pay to support other people.
