Madison - The odds of Racine's recall recount winding up in court increased Tuesday, as Republican Sen. Van Wanggaard's campaign said it may challenge canvassers' decision to accept ballots from voters who did not sign the poll book.
The recount is in its second week after Wanggaard's campaign requested canvassers review an 834-vote victory that favored Democratic challenger John Lehman in the June 5 recall.
Republicans' latest contention of voting irregularities in Racine targets election workers who failed to ask voters to sign poll books as required by state law. The Wanggaard campaign also disputes the Government Accountability Board's recommendation that canvassers accept the votes.
Once canvassers certify the recall, the campaign could challenge the recount in court, potentially delaying Democratic control of the state Senate for weeks. The results of the recount will determine whether Republicans keep the majority or if Democrats take control of the Senate between now and the November general election.
Since 2011, a new voting law requires that poll workers have voters sign a poll book.
Accountability Board spokesman Reid Magney said although failing to have voters sign the poll book is a mistake, it does not invalidate a person's vote. Moreover, it is impossible to know which ballot was cast by any voter who did not sign, which will create a hurdle to any potential court challenge.
"Invalidating ballots based on the failure to require a signature would disenfranchise a voter due to an election official's error," Magney said.
The Wanggaard campaign contends the Accountability Board has no basis for its recommendation.

In all fairness, the signature provision is relatively new. Not all poll workers are familiar with it. The confusion happened with new registrations. Seems to me that they should halt registrations at the polls. I think Racine had about 4000 on election day. That is where the problem lies.
There seems to be NO problem with the fact that being unwilling to disenfranchise an “illegal” voter just happens to effectively disenfranchise a LEGAL voter, especially among the holders of a certain political view. Curious, isn’t it?

This is exactly the reason why the Obama campaign is hiring a couple of thousand lawyers to proctor the 2012 election. Stealing is an option if things don’t go as planned.

The Journal Sentinel is not telling the whole story (shocking I know). Just a few of the things that the State GOP is telling talk radio people:
- there is a supplemental book for same day voters so they have to sign two separate times. In some cases there are no signatures recorded at all in others the signature is completely different from one book to the other.
- voter number is supposed to be assigned to each person voting and in a number of cases there was a question mark next to the name instead of the number or no number at all.
- harassment of Republican poll watchers and ignoring contested ballot requests/signatures
- this was not widespread over the entire voting area but specifically in the city of Racine.
The books are such a mess that the GOP cannot make heads or tails of some of the ward rolls.
The Dems stuffed the ballot boxes with not only fraudulent voters in person but IMO were likely taking matters into their own hands and adding ballots at the last minute when they thought Waangard could still win.
Cheating is possible when subtle...4000 random votes from wards in the City of Racine is not subtle but criminal.
Democrats don’t need no steenkeen laws. They can do anything they want because they are Democrats.
Wanggaard should definitely take this to court.
I don’t get my “key” for the voting machine until I have 1. Shown a picture ID, 2. signed the poll book.
The poll book requirement is as old as my voting memory, the photo ID is fairly new, several years.
I have no idea why Ohio’s photo ID requirement hasn’t been challenged.
