So...using your analogy...if the children of bank robber parents were given the money from the robbed bank...they would be allowed to keep it?

My point was that I don't think the children have legally committed a crime because they do not have the requisite intent as minors. I do think that is an issue. You can have a situation where a child was brought here young, grew up only knowing this country and being model students, and then are forced to go back to a country they don't know when their parents are deported.

However, I do think you make a legitimate argument that if they are allowed to remain they are benefiting from the illegal activity of their parents. That is a real concern also.

The main point of Rubio is that the weighing of these type issues and determination of the best course of action is up to congress and not for the president to impose on his own. I still think that his statement was correct in bringing that up. Ultimately, your point may prevail and I would accept that it is a valid basis for not granting any benefits. I just don't think Obama's governing by fiat is that right way to decide.
