Fro what the article says it sounds like the Supreme Court still has to approve Blackwood's arguments so maybe the parents and state can still be spared another ordeal.

Blackwood is beginning to sound not much better than Baumgartner himself.

Blackwood had a role in easing Baumgartner out of his post instead of letting the latter take a hard fall, so I hear.

Lousy legal reasoning (the debate is over whether Baumgartner had done something to bias the jury, which today is more like a mushroom farm than a panel of enlightened citizens) is one matter. Just plain corruption, like drug dealing with suspects that you see in your court, is another.
