Depending on where the property lines are drawn he might own that "right of way". I own my yard all the way to the street even though there is a sidewalk on which people are free to walk because the original developer yielded that right. The area between the sidewalk and the street is still mine and I can prevent anyone from posting signs on it.

There may even be a fine for doing so.Signs in NM must be on private property. They may not be placed on the public right-of-way, and campaign staff must have permission prior to placing them on private property. Either way, the signs were placed illegally.
