911 Call: Soldier who shot neighbor thought he was assaulting woman

The Fort Bragg soldier who fatally shot her neighbor, Jerry Dale Martin Jr., on Mawood Avenue a week ago believed he was assaulting a woman who was, in fact, his mother, according to the call she made to 911.

That call, from Gracie Lee Ramirez, and others reporting the shooting were released Friday by the Fayetteville Police Department.

Ramirez, 34, who lives next door to Martin's family, is charged with voluntary manslaughter in the man's death.

The shooting happened about 8:30 p.m. in the front yard of Martin's home in The Oaks neighborhood between Skibo and Morganton roads.

Ramirez placed the first call to 911 and said she'd like to call in a report of "domestic abuse," saying her neighbors were fighting in the front yard.

"He was, like, picking her up, tossing her and her friend came over ... I don't know what's going on, but they're fighting," Ramirez said.

Martin, family members have said, was roughhousing with his mother and his aunt.

Again, we’ll wait for the facts. There was one woman who said he was coming after her. He could have been coming toward the soldier.

Not much “stand your ground” in this case since she went into their yard with the gun in her hand.

Could well have been domestic violence - that turned into “we was just playing” after the shot was fired.

But as you say - wait for the facts. It will be telling if there was alcohol involved and they had any prior DV calls on the family.

Also a little telling that they were next door neighbors and the story reads like she didn't know any of them.

Being from here, we just had a soldier killed last week by the police. He was out in his driveway shooting his pistol at 3:00AM. Somebody called the cops, they showed up and ventilated him. Lasted a few days and then died.

Info is still confusing an contradictory, we'll have to wait for an investigation and a more clear account.

One thing is certain, when you leave your own property to defend a stranger, be absolutely certain you know everything that pertains to the situation, or don't.

Gracie Lee Ramirez could spend more than 16 years in prison if convicted in the death of Jerry Dale Martin Jr., a judge told her Thursday.

Ramirez, 34, was calm and composed during her first court appearance on a voluntary manslaughter charge at the Cumberland County Detention Center Thursday afternoon.

Flanked by two attorneys from a Fayetteville law firm, Ramirez spoke only to answer Judge David Hasty’s questions.

Hasty said the charge carries a maximum of 16 years and 9 months in prison.

Neither Ramirez nor attorneys Cull Jordan II and Jonathan Wright offered any comment after the hearing.

It’s alleged Ramirez shot Martin, her neighbor, in the abdomen in his front yard on Mawood Avenue on Saturday.

Martin was horsing around with relatives at the time, his family has said.

Kevin Blake, Martin’s stepfather since second grade, said the family was hoping the charge would be murder, but accepted the detectives’ decision.

“It can be frustrating,” he said. “You just hope justice will somehow be served.”

Martin’s funeral was Thursday. Blake said more than 800 people attended the visitation Wednesday night.

Ramirez, a Fort Bragg soldier who has served three deployments in the Middle East, is not in jail, having posted a $50,000 unsecured bond when she was arrested Wednesday. She is next due in court June 6.

Thanks, even less said in court regarding the family’s or Gracie’s side, just the basics from the reports. As it should be. We’ll just have to wait.
