A federal judge on Friday rejected Sgt. Gary Stein's injunction to halt a military tribunal's recommendation that he receive the discharge following anti-Obama comments he made on a private Facebook page in March, according to court documents.
Stein, 26, has maintained a webpage for the last two years about the armed forces tea party group he founded, including a disclaimer that the views were his own and didn't reflect those of his employer.
But according to his attorney, Stein never ran into any trouble until last month, when he wrote: "Screw Obama. I will not follow all orders from him."

Yes it is a military proceeding but the article was about the civilian court denial.
Now that you mention it, I’m surprised he didn’t go to NJP first. Usually admin discharge is a last resort, not a first option.
No, Service Member are allowed to volunteer for political organizations and attend rallies, but such actions a) can’t interfere with military duties, and b) can’t be done in uniform or in any sort of official capacity.
The Marine in question here blatantly stated on a public Facebook account that he would not obey Obama’s (the CinC) orders. He quickly clarified that to say “unlawful orders” but the damage was done.
I think an OTH discharge is WAAAAAY overkill, but I don’t know how the USMC works with regards to such infractions.
Okay, I misunderstood your post. Sorry about that, it’s Monday. Isn’t it?
You are obviously unconcerned with civility and manners.
And have no sense of humor.
So keep it up FRiend.
Show your enthuiasm by becoming a monthly donor, we could sure use the funding around here. In your case, someone of your generous opinions ought to join the dollar a day club at least, so you can be highly invested in your attitude.
Chainmail: I do not accept shame for my views from you nor anyone else who chooses to act like a jackass around here.
And by the way, regarding your amazingly idiotic ‘gay’ characterization of my aplology response, you might be surprised to learn that my brother was gay, and as a consequence died of AIDS due to his homosexual behavior. So I find your remarks deeply insulting on a moral level. And I am personally active in promoting healthy family creation and heterosexual behavior. What a creepy thing to say to someone on a conservative values forum. You need help. I checked your posting history and you are rude to everyone, so I feel good about not being singled out to be picked on.
The last thing we need around here is a jarhead with a bad case of singed hairs on his redass due to excessive flaming. I believed I issued a cordial, pleasant and humorous reply to your rude assertion that I did something wrong by referring to a marine as a soldier. Well guess what, that is just common parlance, bucko. If my expression of regret was somehow inadequate, well, I am sorry again for that, and you will just have to get over it before people on this board start to think you might be acting like a jerk all the time. “Get over it, Francis.”
Other than that, no experience at all...

That is alright, it was Monday but today is Tuesday.
So exactly how was that comment civil or appropriate or anything but confrontational and for that matter, gay? Does that pass for an apology where you come from?
I'm sorry about your brother - I have a gay brother too and I don't have much hope for him either.
As far as my record goes, it's the record of a man with zero patience for stupidity and no tolerance for insults. I have served my country with distinction and have no reason to accept disrespect. Make sense?
You’re not my old boss, are you?! That sounds like his resume!
I only did 21. Eight enlisted, then warrant officer, LDO, then unrestricted. Personnel officer, adjutant.
Thank you for your service!

It is not clear how many apologies a guy like you needs. So please accept my third one.
This is not the marines, this is Free Republic.
You are the one instigating the disrespect, FRiend. That is a fact.
Do you like kitties? I am series.

Read what this place is all about. You don’t even know me.
Hopefully you will start contributing and last more than a year.
If you want to bring anything up to Jim and the monitors, see how the word "butthurt" strikes them as per your comments. If you want to use gay terms, expect some flashback. No normal person uses that term.
If you can't tell the difference between the army and the Marines, then maybe you should avoid the subject in the future.
Semper Fi!
