The judge could throw it out.

1.) Yes it does, but even a sympathetic jury may fear for their lives.

2.) I wouldn't count on any judge doing the right thing with the whole world watching. This incident has been overwhelmed by politically correct politics. I could see it being overturned on appeal, long after the election.

One of the biggest mistakes they could make is to televise this trial. It needs to be as closed door as possible.
