I read the article and I can’t figure out what the court case is about. Who’s the defendant and who’s the plaintiff?

Mann is the plaintiff, Tim Ball is the defendant. Seems that in pretrial discovery, Ball can ask to see emails bolstering his defense. The author believes that the emails will embarass Mann no end.

The ATI case began quietly in January 2011, with a FOIA request to UVa for e-mails to and from Mann and 39 people, involving five grant programs. Seven months later, UVa produced almost 1,800 e-mails, but said it was withholding another 12,000, which they argued were not public record, or were exempt under Virginia FOIA law 2.2-3705.4(4). The case is scheduled for argument on April 16 in Manassas (in Prince William County, Virginia), in suburban Washington, DC.

This is the case. There is also another one in Canada, apparently, involving Mann suing Tim Ball.

Rudder, I believe Lonesome in Massachussets and Rocky got it right. UVa is being challenged about FOIA jurisprudence, and Mann stepped in it by suing Tim Ball for defamation. He’ll be sworn under oath in pretrial discovery in the defamation suit. IMHO, he’ll drop the defamation suit, or Mister Hockey Stick will possibly risk perjury or obstruction of justice charges.

There are 2 issues and that is what could be confoozing.

One is that ATI is suing U of VA for their refusal to release the 12,000 Mann emails, though they had released them to Mann which they (ATI) argues, nuliffies their (U of VA) argument under the exemption clause of FOI.

The other is Mann suing Tim Ball who is Candian and there is hope he will use the discovery process to discredit Mann.
