Yes, they can switch positions, though fairly uncommon. However, if there’s a case that could sway a justice due to history and politics, it’s this case. Justices have their own legacies to consider and Kennedy may not want the distinction of being the guy that brought down the landmark achievement of America’s first ethnic president.
My opinion is that it’s more historic to have protected the Constitution and shored up other areas of constitutional law that have eroded over the generations.
A rebuff by this court could put other congressional and judicial overreach into play.
