Anything is possible. All of this could be a preemptive strike at the SCOTUS as they are coming to a decision, or to set themselves up to sow unrest because of a negative result.
They have already stated they want to ramp up violent protest this summer. I don't think it matters if they know or not at this point. The assumption is that they already lost and they are making it very clear that they want civil unrest.

You are reading the actions of the Fascists all wrong. They do not want an active revolution. There is no need for it. They are winning a gradual reduction of our rights, and a gradual erosion of our country - daily - for 40 years.
The LAST thing they want to do - is risk the game by a super dramatic action.
We will have some riots, and silliness - but nothing “FEMA Camp” like - at all. They don’t want the frog to jump out of the pot.
Said differently - what is the worst that could happen from their current situation? Obama loses - and Romney wins? A slight decrease in rate of frog boiling - but still making the same dinner.
Obama will just play this from a “What is best for Obama” point of view - I still like my earlier observation.
