Mo. House OKs Candidate Birth Records Requirement

JEFFERSON CITY (AP) - Birth records for presidential and vice presidential candidates would need to be publicly available for those appearing on Missouri ballots.
Political parties would be required to give the secretary of state's office proof of their candidates' identity and that they are natural born citizens of the U.S. Write-in presidential candidates also would need to provide documentation. The records would be open to the public.

As used in this subsection, "natural born citizen" means having been declared a national and citizen of the United States at birth under 8 U.S.C. Sections 1401 to 1409, as amended...
This is based on 8 U.S.C. which covers ALIENS AND NATIONALITY and is positive law, not natural law.
...or having been declared a national and citizen of the United States under federal law as it existed at the time of the nominee's birth.
They've got it all wrong there as well. A natural born citizen doesn't need to be "declared" to be a natural born citizen and only a positive law can "declare" something.

No it isn't! Look at the wording of the bill in reply 22.
It's horrible legislation and shows how ignorant Republican Lyle Rowland is on the issue.

Wow! Seeing this bill has sure driven you into a frenzy of posts. I agree that the bill writers do not have a correct understanding of “natural born citizen” as it relates to eligibility for the office of the Presidency and that is a flaw. However, flawed as it is, it is not a FATAL flaw in my opinion. At least it is taking a baby step in the right direction and offers at least the possibility of shaking loose REAL documentation on Obama’s birth. The alternative is to leave things AS THEY ARE NOW—specifically with no requirement for documentation. Perhaps you’d prefer that?
Now I’m not a fool. I know that in Missouri (with its Secretary of State being the corrupt Robin Carnahan) it will be possible that the bills intentions could be sabotaged in practice by the SOS and/or corrupt judge(s). But this represents (imperfect as it is) movement in the right direction. And that baby step is a legal requirement that valid documentation must be provided.

Seeing this bill has sure driven you into a frenzy of posts.Is there something wrong with trying to inform others that they need to actually read the bill instead of relying on an article for information?
The alternative is to leave things AS THEY ARE NOWspecifically with no requirement for documentation. Perhaps youd prefer that?
IMO the current state of affairs is better than this lousy bill.

I don't know if that's what it's intended to be. I do know that it's a horrible bill.
IMO it basically says a naturalized alien can be POTUS and it steps over the Constitution in defining a natural born citizen.

zer0's being an illegal alien, but that's not what the purpose of the bill is. In fact, it's just the opposite, and it is despicable.

The legal ambiguity will be whether the Secretary of State of Missouri has the right to define natural born citizen and what constitutes proof of that status.And when should the secretary schedule the big secret visit that will be to aid in the decision?

While this feels very good, its practical application will most likely never happen.
So Obama gives them the "Birth Certificate." BFD.
(1)They accept it at face value,
(2)The DNC says he's a "Natural Born Citizen."
(3)Back to square 1.
A responsible state official must simply remove Obama from the ballot, which he has a perfect right ... a duty actually ... to do. The ball must be place in Team Obama's court.
