NEW YORK (AP) — An undercover police detective who fired the first bullets in a 50-shot barrage that killed an unarmed New York City man as he left his bachelor party has been fired and three other officers involved in the slaying will resign, ending a disciplinary process that dragged on for nearly 5 ½ years.
Police Commissioner Raymond Kelly made the decision to push the four officers out Friday, four months after a department administrative trial judge concluded that detective Gescard Isnora acted improperly in the 2006 killing of the would-be groom, Sean Bell.
NYPD spokesman Paul Browne said Friday that "there was nothing in the record to warrant overturning the decision."
Isnora and fellow detectives Marc Cooper and Michael Oliver and Lt. Gary Napoli were widely condemned and brought up on criminal charges following the shooting outside a Queens nightclub, but were acquitted on all counts following a trial in 2008.

Five years, and the only justice is the guy got fired? He can probably be rehired within three years with some arbitration efforts by the union.

Detectives Isnora and Cooper are black (as was Bell) while the other two cops are white.
Apparently the scales of justice are balanced out by a couple of each.

I think in a case like this any action subsequent to an officer yelling “gun” or actually shooting is easier for the latecomers to the shooting to defend. The first cop that reacts is going to set off a justifiable chain reaction in terms of other cops backing him up, since at that point they react as though the threat has been verified & is real. The pressure really is on the first cop who draws/fires; he best know what he is doing.
In a similar story, years ago an African immigrant was shot in NYC by detectives looking for a black suspect. They asked him to stop, and he approached them reaching for his wallet (I don’t think it was ever established that he spoke English or understood that they were looking for a perp). IIRC, one the cops fell off a stoop in the scuffle and broke his tailbone; when he reacted his partners thought he had been stabbed or shot, and they killed the immigrant (who wouldn’t respond to their verbal commands to drop what he held in his hand, or to get down on the ground). I don’t think those cops were ever charged with anything; it was an unfortunate but understandable chain of events.
