Madison - The Wisconsin Judicial Commission filed formal ethics allegations Friday against state Supreme Court Justice David Prosser for a June incident in which he placed his hands on the neck of Justice Ann Walsh Bradley.
The commission asked the high court to send the case to a panel of three appeals court judges to consider whether Prosser violated three ethics rules. The panel's findings would then be sent to the high court, the only body that could make a binding ruling against Prosser.
The confrontation between Prosser and Bradley occurred in front of all but one of the other justices, who will have to decide whether to weigh in on the case or step aside. Stepping aside would effectively end the case.
"This is not about whether Justice Prosser is a good or bad guy," said Franklyn Gimbel, a prominent Milwaukee lawyer who was hired as special prosecutor by the Judicial Commission. "This is not about whether Justice Prosser is a good or bad judge. This is not about his judicial philosophies. It is about whether or not his behavior on June 13, 2011, was violative of the ethical requirements for a judge."
Prosser issued a statement Friday criticizing the commission's complaint, suggesting it is politically motivated. He said the commission is "trying to accomplish through this prosecution what some of its members failed to achieve at the ballot box."
"The charges filed by the Judicial Commission are partisan, unreasonable and largely untrue," the statement said. "They will be vigorously contested because I am innocent."
Bradley declined to comment through a court spokeswoman.
It is the third time since 2008 that formal ethics charges have been submitted against a Supreme Court justice. Before that, it had never happened.

I am saying we’d all be outraged if they did this to a rape victim and understand why they may go after a smarmy reporter’s mic, or anyone else who is the victim, not the attacker. Prosser was the victim here but you seem to be fine with him being treated that way and somehow can’t understand why he may have lost it being hounded by a liberal biased press who deliberately isn’t telling the story accurately.

Yes, people who are not from Wisconsin have no clue as to what Madison is all about, and how biased the place is against conservatives and republicans. It is well over 70 percent democrat and it is the most liberal city in the state. The real hardcore liberals are there. All the circuit court judges there are all, ALL of them, liberal. The WI supreme court of seven judges is there, and is split 4-3 conservative. The libs on the court HATE this, and many justices hate each other personally. The libs are insane with hate they do not control the state supreme court and they are doing their best Obama-Chcago tactics to destroy one of the conservative justices one way or the other. They are lying about this and the press in Madison is uber liberal and only parroting the phony story. Nobody there will demand they report fairly.

You are EXACTLY right. The libs are besides themselves that they don’t have a majority on the Wisconsin supreme court.
If I’m understanding this correctly, issues like this usually get decided by the WI Supreme Court. However, all but one of that court’s members were “witnesses” to the so called “incident” and thus would have to recuse themselves and thus prevent a quorum. In this case the Chief Justice (one of the two justices that MOST HATE Prosser and the fact that the libs are consistently out-voted 4-3 on their favorite issues) would appoint a 3 judge panel to consider the issue. And FReepers, just imagine the ideological make up of those appointees.

By the way, I think if Judge Judy were hearing your posting she would say something like: “ I don’t believe you, I think you care A WHOLE LOT about the politics involved.
You need to hear the WHOLE story. If I recall correctly, he shoved her away to get her away from him. She was being really aggressive. There are plenty of witnesses, and the only ones who are keeping the charge alive are politically motivated. The judge didn’t do anything wrong.

Seems they are bringing charges against the wrong judge. If SHE attacked HIM, who then was out of order? If I were Prosser, I would get the charges reversed and then “go for the throat” (sorry< I couln’t resist).
Yes they are—to moral people. To the progressives, bringing charges against someone (whether baseless or not) is all about destroying a person perceived as standing in the way of progressive action.
That was what the prosecution (and political destruction) of Senator Stevens of Alaska was all about and that is what these actions against Prosser are all about. “The end justifies ANY NECESSARY means” in the minds of progressives.
