Madison - The Wisconsin Judicial Commission filed formal ethics allegations Friday against state Supreme Court Justice David Prosser for a June incident in which he placed his hands on the neck of Justice Ann Walsh Bradley.
The commission asked the high court to send the case to a panel of three appeals court judges to consider whether Prosser violated three ethics rules. The panel's findings would then be sent to the high court, the only body that could make a binding ruling against Prosser.
The confrontation between Prosser and Bradley occurred in front of all but one of the other justices, who will have to decide whether to weigh in on the case or step aside. Stepping aside would effectively end the case.
"This is not about whether Justice Prosser is a good or bad guy," said Franklyn Gimbel, a prominent Milwaukee lawyer who was hired as special prosecutor by the Judicial Commission. "This is not about whether Justice Prosser is a good or bad judge. This is not about his judicial philosophies. It is about whether or not his behavior on June 13, 2011, was violative of the ethical requirements for a judge."
Prosser issued a statement Friday criticizing the commission's complaint, suggesting it is politically motivated. He said the commission is "trying to accomplish through this prosecution what some of its members failed to achieve at the ballot box."
"The charges filed by the Judicial Commission are partisan, unreasonable and largely untrue," the statement said. "They will be vigorously contested because I am innocent."
Bradley declined to comment through a court spokeswoman.
It is the third time since 2008 that formal ethics charges have been submitted against a Supreme Court justice. Before that, it had never happened.

The incident has been extremely well documented.
She charged at him in the doorway of the office she was sitting in with fellow friend and lib justice Shirley Abrahamson, and he put his hands up on her chest to prevent her from bashing into him.
One of the other justices in the room said “Stop it Anne, this is not like you!”
Under oath she admitted he did not choke her as she had said earlier to the media.
The whole deal behind this is the Wisconsin Supreme Court is not in the hands of the liberals, and they have been continually attacking two of the 4 conservative justices through any and all phony attempts. Bradley was the attacker/assaulter but they’ve tried to spin her as the victim.
Self defensive trumps the liberal path to self actualization.
Prisons and grave yards are filled with liberals that have tried this path.
It’s a Madison reporter. The media there has never cared about reporting the story accurately, they have just been hounding the guy. Madistan is a very, very hard place to live in when you are a conservative and you know you can’t get a fair shake from the media, much less your fellow judges.
He was the victim in this story. You think a rape victim wouldn’t be pissed and take a reporter’s mic if they asked her what she did to deserve being raped?
Prosser is one of the good guys, and the allegations were complete bullshit. You might want to take some time to understand the issue before posting.

I will agree with one part of your (weak) analogy; it doesn’t matter who started it. It is incumbent on adults - especially judges - to know how to diffuse tense situations. There is a boatload of bad judgement demonstrated.
