KABUL, Afghanistan (AP) -- A U.S. military spokesman says that no decision has been made yet about whether to hold the trial of the man accused of killing 16 Afghan civilians in Afghanistan.
Col. Gary Kolb said Wednesday that "no final decision has been made yet" about where the staff sergeant will be tried.

There is talk that they might face the death penalty and that last execution was in 1961.
The death penalty certainly is on the table for this offense, if he is found guilty. I don’t have a problem with that, but I -do- have a problem with holding the trial in Afghanistan. The trial should be back here in the US.
I agree. The trial should be held in the United States.
From what I’ve read, this soldier may have been mentally deficient (or battle damaged). I can’t imagine that a trial in Afghanistan would allow for his mental problems. If this becomes a show trial for the Afghanistan’s, then that will be the final straw for me.
That’s pretty rich from an administration that opposes the death penalty, but if they have the trial there you can bet the guy will be dead sometime during the trial and maybe everyone in the courtroom as well. The Amish will bring in a bomb or there will be a whole lot of shooting. Knowing the Obama administration they may even toss him to the local civilan courts.

The last execution was held on April 13, 1961 when U.S. Army Private John A. Bennett was hanged after being convicted of rape and attempted murder. There has been 135 people that has been executed since 1916.

In 1984, the death penalty was reinstated when President Ronald Reagan signed an executive order adopting detailed rules for capital courts-martial. Among the rules was a list of 11 aggravating factors that qualify defendants for death sentences
Does it matter that had these 16 people died as the result of an Al Qaeda suicide bomber, this story would have lasted 1/2 day in this media?
If this guy is tried in an Afghan court, the only decision will be the method of his execution!
I’m willing to entertain the idea that he has some kind of mental defect, especially due to his previous brain injury, and this additional stress of something wrong on the home front. Those things may go a long way toward explaining what happened, but they still don’t excuse what happened.
If he really did what he is accused of doing, he’s just got to stand before that long green table.
I have a problem with that. The man was on his 4th deployment, had a brain injury and had problems at home. The army had no business sending him into a war zone.

Has there been any talk of an insanity plea? Was he “sane” when he did this or did he crack up and then do it?
When the insanity plea is used, the defendant is not denying that he/she committed the criminal offense in question. In actuality, he/she is admitting that he/she was responsible for the crime.Insanity defenses are rarely successful.

Why we haven’t seen the murderers of those soldiers killed after the koran burnings? Were they arrested? Are we demanding that they be tried in US courts? Have we gotten apologies from Karzai?
Why haven’t these questions been asked?
