The petite, Brooklyn-born nurse who tussled with Robert F. Kennedys son in a hospital maternity ward was stunned that she fought with a member of Camelot, her husband said Saturday.
Steve Luciano, 57, said his 5-foot-tall wife, Cari, was just doing her job when she tried to stop Douglas Kennedy from leaving the hospital with his 2-day-old baby boy.
Her comment to me that night was, I was assaulted tonight and could you believe it, it was a Kennedy who did it? Luciano told the Daily News on Saturday in front of his Hopewell Junction home.
He said his wife and nurse Anna Lane were simply trying to stop Kennedy, 44, from leaving the Northern Westchester Hospital with the baby, Boru, on Jan. 7 against hospital rules.
Steve Luciano said Kennedy kicked his wife in the pelvis and twisted Lanes arm. The scuffle was caught on security camera.
My wife was assisting Anna to simply encourage Mr. Kennedy to place the child back into its bassinet, Luciano said. It appears on camera that they stumbled into the stairwell and then he veered back and kicked Cari and she went sprawling to the floor.

Luciano said ... I dont think that anybody, even a Kennedy, should go around kicking hospital personnel and believe there are no ramifications, he said, adding that a civil suit was a possibility.

I can’t believe it took 20 posts for somebody to mention “abduction.” Can you imagine how this Son of a Kennedy would be acting of some other chap were walking out with Kennedy’s 2-day-old baby and the hospital did nothing to stop him?

Whether it is a case of kidnapping is entirely determined by legal custody. The trial would go something like this:
KENNEDY LAWYER: "To whom does the responsibility of payment for services rendered ultimately fall?"
HOSPITAL ADMINISTRATOR#1: "The recipient."
KENNEDY LAWYER: "And if the recipient is a small child?"
HOSPITAL ADMINISTRATOR#1: "Then it would become the responsibility of the child's legal custodian."
KENNEDY LAWYER: "Thank you. Next witness, Your Honor."

KENNEDY LAWYER: "If Mr. Kennedy's insurer were to deny a part or all of the claim on his child's medical services, to whom would send the remainder of the bill?"
HOSPITAL ADMINISTRATOR#2: "Mr. Kennedy himself."
KENNEDY LAWYER: "Thank you. No more questions. Your Honor, I suggest that the case against my client be dismissed now so that we can expedite the attempted kidnapping case against the Hospital."
The Hospital's policy is squat in a court of law.

So you are OK with people walking out of hospitals with infants and children, as long as they say, “yep, this one’s mine.”
I presume that is OK for schools as well then?

The obvious point that you circumvented is immediate custody. You don’t exchange it without proof.
I had a duplicate thread which included several sober statements on hospital protocol related to patient safety - especially as it relates to potential newborn abductions by strangers. The hospital is held responsible for patient safety until formally discharged.
It has happened and hospitals are not only correct in having security in place to prevent it - but there is also the tragedy for parents and liability for the hospitals to consider.

but two days?..makes me think the baby was jaundiced or had to be watched...maybe a little small, preterm...maybe needed to be kept cuddled up...to keep the temp. up...
but you don't think that hospitals and doctors and nurses have to TOW THE LINE to prevent law suits constantly, and for anyone to just leave the floor with a newborn is NOT THE NORM...
first of all, not everyone knows that you're the father Mr.Kennedy...and not everyone knows that you just want to take the little one out for some "fresh air"....
if that was your little baby, freepers, you would want to know that there are people that would stop just anyone from walking out with your kid...
some freepers are on both sides of the street...protect my baby but don't really protect my baby....
those nurse that got accosted had no way of knowing for sure if Mr. Kennedy was the father, or that he was just taking off with somebodys else's kid or if the mother of the baby approved...
good for the nurses....
but what you can not do is to take another human being that is the offspring of TWO adults out of the hospital without gaining signed consents from everybody and his brother....
of all the sick stories about ugly custody battles here on FR one would think that the actions of the nurses was a no-brainer....
and to think a nice looking man, or woman, could just take a baby outside off the floor without causing a stir......insanity...
I think that even a Kennedy should be smart enough to know that you don’t just pick a baby up from the hospital bassinet and walk out the door.
Just like the mother didn’t walk in off the street and lay down and have the baby.
The obvious issue is getting a proof of custody. Hospitals take their custodial responsibilities very seriously. They don't let anyone who comes in take a child. Nor do they just take your word for it.
If I'm given $50 to hold for someone, I get proof of ID before I give it to them. One would hope that the same goes for children.
Out of curiosity, what do you think the rules should be at a hospital concerning people who walk in, pick up a baby, claim to be a parent, and head for the door? Further, what do you expect of a hospital, school, etc. when someone claiming to be a parent grabs your child and heads for the door?
Wow! They won’t let your kid leave without being branded that number? That says a hell of a lot where we are now in this country.
