Rush didn't say this is the best argument we have against Obamacare but what this does is undermine Obama’s own argument in front of the Supreme Court that this is a tax.

Obama’s whole argument is that congress has the authority to tax but now they say it isn't a tax.

It's pretty clear to me that Zients unequivocally said it's not a tax.
