It was in front of a congressional committee. All the plaintiffs arguing in front of SCOTUS has to do is read this statement and the Supreme Court will have no choice but to rule it unconstitutional. There is nothing in the constitution that allows the Government to fine someone for not purchasing a product.

Oh, come on! You've not heard how Axelrod's words about Blagojevich's pay-to-play scheme regarding Obama's newly vacant Senate seat were conveniently declared "mispoke[n]?" Zients' testimony will certainly not be allowed to create logical dissonance to the administration's position before SCOTUS.
