That, to me, is definitive. If you don't punish the perpetrator, you are the perpetrator.

Same logic as should have been applied to the "Who hired Craig Livingstone?" question.

Filegate happened on Clinton's watch, and he did nothing to punish file gate. So that only leaves one suspect in the case - the president.
