The head of the National Park Service defended his decision to let Occupy protesters camp out in a park in the middle of Washington, D.C., though he said Tuesday the group will be given one last warning before being evicted.
NPS Director Jonathan Jarvis testified to the House Oversight and Government Reform subcommittee on the District of Columbia that protests are a right under the First Amendment, although he acknowledged that some homeless people "have taken advantage of the situation."
He added that this is not the first time the Park Service has allowed protesters to remain for weeks at a site.
"Whatever they are protesting is irrelevant to our decisions. Our decisions are based on the totality" of the circumstances, he said.

The Park Service encourages Tea Party protests when they need to clean up their parks.
Damn misleading headling as there are a whole passel of obammy officials I’d like to see get beat like rented mules.
It's worse than a non sequitur ("it does not follow"). It's a self-contradiction.
Regards,
All this crap about being too poor to afford a voter ID or get to the polling places (most of which are a 10 minute walk, max, in most inner cities) reminds me of a piece which aired on Japanese television when I lived there.
The Japanese still have actual journalists who ask actual questions, believe it or not. Their reporter was interviewing a black guy in Philadelphia about how some of their inner city precincts had voter turnout approaching 100% when the best white neighborhoods in, say, top turnout states like Utah or Minnesota could manage 80% at best.
The Japanese reported pressed the guy as to whether those numbers were actual voters. The guy finally broke into a silly grin and said "What do you think? We don't get even 70% turnout when we're giving away free cheese!"
"I object!"
Overruled.
"Then I strenuously object!"
Great movie. Nicholson was supposed to be the bad guy, but frankly, I liked him more than all the smarmy lawyers and "stupid, knuckledragging, neanderthal" Marine stereotypes.
:-) Nice to dream.
But, they don't do it for the same reason that PETA terrorizes little old ladies in fur coats instead of Hell's Angels in leather jackets.
