Elderly widower shoots, kills intruder during burglary in Daytona Beach(FL)

Police said an elderly Daytona Beach widower was "well within his rights" to shoot and kill a burglar who tried to force his way into his beachside home Thursday morning.

Police Chief Mike Chitwood said 82-year-old Charles Robbins was awakened by the noise of someone trying to break in at about 6:15 a.m., armed himself and shot through the door in the 300 block of Woodland Avenue, killing 24-year-old Tyler Orshoski.

"We're thankful he did something the criminal justice system couldn't do and he put this guy out of business this morning," he said. Chitwood said the homeowner's wife died recently.

Robbins used a .45-caliber handgun to shoot Orshoski once in the abdomen, according to police spokesman Jimmie Flynt. The suspected burglar died on the porch of the house.

Initially, police thought Orshoski was behind a series of burglaries in the area. But after removing Orshoski's ski mask, they could not confirm whether he was involved, Flynt said.

Police said they did however find pry marks on Robbins' door and Orshoski was carrying a flashlight, screwdriver and hammer, he said.

Orshoski has been charged numerous times in the past with drug possession and burglary; however his family said he never did anything that would merit being shot to death.

"He was not the scum of the earth," said Orshoski's sister Breckin Moloney. "I don't think my brother ever deserved to be shot. It's atrocious and appalling that [Robbins] gets a verbal pat on the back for this from the chief of police."

Moloney said her brother was engaged to be married and her family is shattered by his death.

Shit happens. It could happen to my son, but I would blame myself instead for not taking a stern enough approach to raising my son.

In all honesty I do believe America is reverting to the old west in some ways. People will die, people make wrong choices as well. I do think the motto “kill or be killed” comes to mind to a lot of people.

We have no way of know the final intentions of an intruder, its like we can just check their intruder credit rating or facebook page.

Its sad when people die, its sadder yet that the reason they died is being blamed erroneously, they chose poorly.

It's only a matter of time until an innocent producer is destroyed by this perp.

Better we save the producer and efficiently rid society of the parasite.

I wonder how his sister would feel if someone broke into her residence and robbed her, raped her, tortured her, and left her for dead?

There have been an extrordinary number of home owner shooting thugs postings of late. Rather than a reversion to the wild west, I think it is an expression of empowerment by honest people. This old man did not deserve to be attacked by the young thug. Had the old man not been armed, the punk could well have killed him. When the punk attempted illegal entry into the house, one can only assume the worst and act appropriately. A dead punk is a blessed outcome.

I would definitely disagree with his family.

Mr. Robbins, the homeowner, is 82 years old. What was likely to happen to him if he had been unarmed?

Did this nitwit think her brother was breaking in to offer his services as a window washer? His obvious intention was to deprive the homeowner of his property. He could easily have deprived the gentleman of his health and even his life.

That entire family needs to be run out of town. I think they are dangerous people. The son was the product of his family, and Breakin, his sister, played a huge role.
