WASHINGTON (Reuters) - Congressional Republicans, who are urging President Barack Obama to give a permit to the Canada-to-Texas Keystone XL oil pipeline project, are working on a plan to take the reins of approval from the president should the White House say no.
Senator John Hoeven of North Dakota, a state counting on TransCanada Corp's pipeline to help move its newfound bounty of shale oil, is drafting contingency legislation that would see Congress green-light the project, an aide told Reuters.
After delaying the $7 billion project past the November 2012 election, Obama was compelled by Congress to decide by February 21 on whether to approve the pipeline that would sharply boost the flow of oil from Canada's oil sands.
Should Obama reject the pipeline, Senate Republicans would look at a bill that would force the go-ahead for work to begin, said Ryan Bernstein, an energy adviser to Hoeven, citing the powers given to Congress in the Constitution to regulate commerce with foreign nations.
"We believe that express authority in the Constitution gives Congress the ability to approve and move forward on such a project," Bernstein said in an interview.

If Obama won’t do the ‘right thing’ why can’t Congressionnal Republican just go ahead and authorize the pipeline on there own? After all thet’s why Obama made recess appointments while congress was in session.
I’m wondering if the House Republicans have forgotten that there is a thing called “The Senate” and it is run by a guy named Harry “DOA” Reid. Good old Harry just might object to anything that takes power away from His Majesty, King O.
Are we sure the pipe line people are not vulture capitalist, what laws will we have to control their profits???? What laws to make sure that they fire no one and provided life time employment in the numbers they forecast. Just trying to help out the primaries and remain current on the political position of conservatives . Soff
Sounds like a plan to keep the issue in the spotlight if Obama is stupid enough to reject building the pipeline. Whether or not Republicans prevail in court it will serve as a hammer during the summer for the GOP candidate to use against Obama.

Hmmmm. Yes, I pretty sure we're talking about the same guy. He lives in a really big white house in Washington D.C. and struts around with his wife like they are King and Queen of our domain.
I think Speaker Boehner should give Harry Reid one week to “schedule” a Senate vote on this.
If no vote is scheduled, then Speaker Boehner should say: “We can’t wait for these 40,000 jobs!”
and then state that, “Since there no evidence to the contrary, we believe that the Senate HAS approved these 40,000 new jobs. We can’t wait!”
Similarly, if Obama refuses to sign the bill, Speaker Boehner can say, “We deem this bill to have been signed into law. We can’t wait for the 40,000 new jobs!”
I you really want to use democrat terminology, then the House can just Deem the project approved.
So what. Being afraid to do anything right unless there's "bi-partison consensus" is what sets them up for defeat. As with the budget, it's important to push ahead regardless, and let everything always be at the feet of the Do-Nothing Senate.
Don't get me wrong. The House should feel free to pass this sort of legislation. But it isn't going anywhere with the Senate, at least I don't think so. In any case my comment was not aimed at the House. It was aimed at Freepers who might be thinking this is a done deal and Keystone here we come.
OTOH, there just might be enough Dems to get it passed. That is assuming Harry "DOA" Reid actually puts it to a vote.
