He didn’t say it was a simple matter of 2/3. He said if the other two branches didn’t favor a ruling, the Court “would lose.” Not by mere count but by actions taken by the other two branches. It’s pretty obvious the Legislature can go around a ruling, even without the President. Or if the Legislature and Judiciary have decided that the President ought to back off, reverse course or even step down — he’d better.
Gingrich tried to make it simple for a brief interview. Anyone who understands what’s meant by “tyrants in black robes” ought to be thanking him for bringing this issue to the fore.

Correct. From here:

"The power to review the constitutionality of laws may be limited by Congress, which has the power to set the jurisdiction of the courts. The only constitutional limit on Congress' power to set the jurisdiction of the judiciary relates to the Supreme Court; the Supreme Court may exercise only appellate jurisdiction except in cases involving states and cases affecting foreign ambassadors, ministers or consuls."

We are aware of the spotted owl ruling as well as many environmental rulings that took land and jobs away from American citizens. Some rulings have interferred with drilling for oil. Let’s see how the SCOTUS rules on Obamacare and IF they side with Obama..come back on FR and see if Newt is right. Will the Supreme Court view Obamacare as being constitutional? or will they strike it down. BET a lot of Americans would be ready to march on DC and arrest them. BTW...a federal judge was recently impeached for doing hard core drugs while ruling on major cases.
