The law is broken when one of them does an "overt act" to complete the agreement, and the person who commits the "overt act" is the one charged for solicitation.
A female decoy will make an offer to have sexual intercourse or oral sex with a man and she will tell him how much it will cost. If he agrees she will tell him to to to a nearby house or motel, or drive around the corner. If he goes to the house or motel, or drives around the corner he gets arrested because he committed the first "overt act" to complete the agreement. In he report the decoy will state that when the male left, she walked in the opposite direction.
These can be highly successful sting operations and a LOT of arrests are made. So, when a headline reads that a man has been arrested for "soliciting a prostitute" it is possible that he didn't do the actual solicitation. If this was a sting operation, it is possible that Chavous agreed to pay for sex, but did not make the solicitation.
