I did not say they existed because of the constitution. But it is the only thing protecting our rights.

The government is constantly trying and in some cases succeeding in eroding away our rights.

Absolutely right!! The Bill of Rights (First 10 Amendments) merely set forth those rights which are inalienable, and which CANNOT be taken away by anyone.
