Yes, but the courts could still throw the OWS gang a curve-ball, if the property owner decided to make a fight of it.

That's why the fleabaggers chose a piece of property that had been "bought and paid for" by the administration (see link upthread). The property owners are complicit in this.

The courts doing one thing right will never off set all the damage they and the politicians have done as far as property rights are concerned.

Think about it, do you or anyone you know ever think to ask the owner of timber land if it is all right for you to hunt or fish on that land? How about camping and camp fires? People totally disregard land owners rights.

You ought to see my liability insurance bill for property we hold. And do you know who pays that bill? You and everyone else that uses any kind of US wood product.
