Cain camp considering legal action against Politico

A few moments later? My understanding was that in the morning he said he didn’t know the details and by evening time he was able to give more details about the settlement. Perfectly reasonable for somebody who didn’t know in the morning and checked it out by evening.

What you’re ignoring also is that he is legally bound to not disclose anything that hasn’t already been disclosed. So what he COULD say depended on what facts or allegations any reporter actually spit out about the case. If it seems like Cain’s answers were a moving target it’s because they HAD to be, because Cain honors his legal obligations.

If you’ve litigated these kinds of cases you know all this, and you have no excuse for acting as if you didn’t know it.

Regarding what could make another person uncomfortable, my husband is a pastor and I can tell you that some people can be offended by ANYTHING, and they wonder how the pastor could possibly not know they are offended! My husband has gone months without even knowing that something he said or did was taken wrong by somebody who then bad-mouthed him ever since. The NRA’s investigation found that the accusations were too piddly to do anything about, and it is entirely conceivable that Cain is like my husband - being lambasted behind his back for being “insensitive” when it never even occurred to him that somebody took offense at something he did. He did say that his motion about how tall his wife is was mentioned in the complaint. And the initial Politico report, if I understand correctly, claimed there was a non-sexual gesture that made the woman uncomfortable. If they were in close proximity maybe she felt like her personal space had been violated; some people have different comfort levels that way. But what Cain commented on matched the kind of behavior Politico said was in question. Unlike this morning’s latest version of events, which had Cain raping a woman at his apartment...

I’m not sold on Cain either. But this was going to come out and it’s better that it be sooner rather than later.

You’re right, if nothing more concrete gets reported, it blows over except for the way Cain and his team have handled it. There’ll be a yellow flag raised over his potential issues with women and more later in the campaign surprises, should they emerge; and a red flag over Cain’s veracity and the competence of his team.

Nothing more on either count and he’s still the leading non-Romney.

Your gut feeling is that Cain is the type of man who sexually harasses women and lies.

That’s fine. As I said, just don’t try to fob off your opinion as having a shred of direct evidence that Cain has sexually harassed anyone or lied about it.

As for you being an experienced litigator in employment cases, that could cover a lot of ground. I stand by my assessment that you are not well-informed if you believe that the vast number of cases that never reach litigation, but which are resolved in arbitration or even just at the HR level, do not involve stuff such as the gesture described in this case (which, IIRC, was not first said by Herman Cain) and things such as a woman not being included in a golf outing.

Further, you most certainly must be plaintiff’s counsel in the cases you litigate, because you handle the facts as though the only thing that matters is their emotional appeal, as opposed to a a litigator whose analysis is framed around the elements of proof and the standard of proof for each.

Finally, I have never stated my opinion of Cain’s character, nor have I stated that I support him or will vote for him.

I am simply trying to inject some actual reasoning from the actual evidence into this discussion.

So please don’t try to boil down my per se objection to your analysis to a difference of opinion on Cain’s character or conduct or fitness for office.

My objection is that, while it’s certainly your call to ding Herman Cain for any or no reason you want, it’s not accurate to claim you are doing anything more than following a personal hunch.

Cain doesn't have any records of these events. The severance agreements were between the NRA and the women in question.

Phone records. E-mail records. Credit card records. It's all fair game should Cain be so foolish as to initiate legal action against Politico (for what, exactly?), and who knows what might be found related to "these events." If Cain hasn't already committed political suicide by his botched response to the story, suing anyone would certainly seal the deal.
