So, by process of elimination...
If Cain recused himself from the investigation...
...and turned it over to his general counsel and HR manager...
...and the woman likely hired an attorney of her own...
...and if Cain didn't sign the agreement because of his recusal, but his delegated next-in-line did...
...then the cast narrows to a very few set of actors.
It's either the woman herself or her lawyer, or Cain's general counsel or HR manager at the time, or the other executives in the line-of-command who had to approve and/or sign the agreement, or somebody in the court system at the time who processed the agreement.
Any way you look at it, somebody violated the terms of the non-disclosure for political reasons.
Coincidentally, isn't that what happened to Jack Ryan's sealed court records in Chicago? Even more coincidentally, isn't that what happened to Blair Hull's sealed court records in Chicago, too?
