Bloomberg: Occupy Wall Street's Tents Aren't Protected Free Speech

Proving that Mayor Bloomberg enjoys dancing on the razor's edge of public opinion, Hizzoner told reporters yesterday that he doesn't believe the Occupy Wall Street tents set up in Zuccotti Park are considered protected speech. "I'm 100 percent in favor of protecting—1,000 percent in favor—of giving people rights to say things, but also we have to protect those who don't want to say anything," Bloomberg said.
He continues, per his eponymous news outlet:
There are places where I think it's appropriate to express yourself and then there are other places that are appropriate to set up a tent city, and they don't necessarily have to be one and the same. The Constitution doesn't protect tents, it protects speech and assembly.
While a 1984 Supreme Court case involving protesters who wanted to camp on federal land seems to back up the mayor's assertions, Bloomberg distinguishing tents from the protesters' right to occupy Zuccotti Park seems specious. There are plenty of rules in place at the park that are currently not being enforced because doing so would provoke a potentially violent confrontation between peaceful protesters and the NYPD.

Meanwhile, this idiot Bloomberg once fined a business in Brooklyn for having an ash tray on the premises.
I thought of this when some town in NJ evicted a Obamaville tent city last year, if the tent people had simply painted protest messages on each and every structure and named a few people as the performing artists, there would be no legal precedent in NJ to remove the structure as long as the protest was continuously ‘manned’ by the homeless people.
Basically with some graffiti jumbo paint markers (which many of the cardboard signs were made with) writing messages on the tents make the tents a banner, and 1st Amendment banners are given very strong 1st Amendment protections inside NY State and New York County.
The protections are so strong every single Captain and Sgt. in NYPD/County Sheriff/State Trooper at the site will immediately recoil at the idea of touching the tent/banner because the consequences of a successful lawsuit against the LEO’s dept will deep six the officers’ careers and possibly severely reduce their pensions if they get the boot before the golden number.
