Restaurant owner charged with shooting

TOWN OF NEWBURGH — Town police have charged a restaurant owner with shooting two young men after a crowd of unwanted guests crashed a party last month at his business.

Al-van Brown, 50, of the Town of Newburgh, faces charges of first- and second-degree assault.

Police said Brown shot a 16-year-old and 23-year-old on Sept. 10. Brown is a co-owner of Elvedge Restaurant, Bar, and Lounge. The newly opened restaurant on North Plank Road hosted a birthday party for a teenage girl that night, police said. Everything was going fine until word of the party spread through text messages and social networking sites. Police said dozens of uninvited teens began to arrive in cabs and private cars.

The partycrashers were ejected after a disturbance inside, police said. More problems followed. Restaurant windows were smashed. Car windows were smashed. Brown pulled out a handgun and shot two of the young men, police said.

Lt. Michael Clancy said they interviewed Brown within an hour of the shooting and he told them he feared for his life and shot in self-defense.

In the weeks that followed, town detectives sorted through five or six versions of what happened that night. Many witnesses didn't want to get involved, Clancy said. In the end, detectives could find no threat serious enough to warrant shooting someone.

They charged Brown on Tuesday, and he was due to be arraigned in Town Court later that night. The two young men have both returned home from hospitals in the area and are recovering.

Smashed windows and vandalized cars isn't doesn't meet the standard of self defense? If anything Mr. Brown deserves a medal of honor.

And did I understand that this was his business they were vandalizing?

How is this any different than the Koreans in LA shooting looters during the riots in the 90s?

Does Michigan not have stand-your-ground laws on the books?

This is upstate New York, if I’m reading correctly.

Message to would-be business people in Upstate NEW YORK.
Find a location where your business will be actually protected and safe-guarded from roving bands of vandals by the local police.
It seems that ALBANY has voided the idea that one has any right to protect his/her own property.
There are many other states that will welcome you with open arms. Those arms are open to “SERVE and PROTECT YOU”.

And where were the police when all this was happening???

POLICE - When seconds count, they are just minutes away.

In this case, it sounds like they were completely absent.

This guy deserves a medal. The little thugs all should be charged with some felony.

Wait a minute, that restaurant owner didn't make it on his own, ya know. Then DNC talking points tell us so. In fact, they take pains to say police protection from roving bands is one of the "critical success factors" that society provides to the proprietor, a provision for which the owner must pay dearly. Liz Warren told us this.

His life had to be threatened by the yutes he shot. If they attacked him, he’s got a chance of a self defense argument, but still hard in New Yawk.

The feral yutes are a big problem for America.
