Shouldn’t the court decide whether he renounced his citizenship or do you believe the justice dept should do so?
A simple indictment or a court ruling would have alleviated any question of legality.

No it wouldn't. There will always be some element of doubt. No matter how hard the government tries it might be doing something illegal. And there will always be people like you pointing out how it might hypothetically possibly be doing something illegal.
