Texas Gov. Rick Perry is defending his policy of allowing tuition assistance for illegal immigrants at state colleges and universities, saying the lack of a cohesive federal immigration policy forced his hand.

United States v. Wong Kim Ark, 169 U.S. 649 (1898) was also decided on fourteenth amendment grounds.

What is your cite for the proposition that "the supreme court said the 14th did not apply to illegals."? How do you square it with the 14th amendment remarks in Plyler?

Everything you wrote, I would be for 100 percent. It’s not our fault that they snuck over the border to Texas. In 10 years, Perry has been watching and welcoming. Put them in detainment camps in Texas until they get deported would be welcomed. Have them take 30 years to get back into the US.....perfect. Put up a Berlin type wall? You betcha. I love everyone of your ideas. You have the best immigration policy I have seen.

If the 14th had applied there would not have been a case. Damn. And the decision was in kim that his parents were legally domiciled in the country when he was born. They were legal immergrants and were approved to become citizens when they left and went back to china. They were not illegals. Your day is court is still there.

Dallas Texas, 2006: This occurred under Governor Perry, and 8 years of a Bush presidency, 500,000 illegal aliens march on Dallas, pushing foreign flags in our faces, while making demands and threats...During war time no less.

Where was Perry's outrage then? Did he take to the airways and blame Bush and the feds? No he didn't. Did he go on television during this disgrace and demand relief? No he didn't. What he did do was aid, abet and embolden this lawlessness, just as Bush did.

And it's only become worse.

Every political season every politician harps about immigration reform.No one ever does anything about it because it would take some votes away from them.As Latino’s would vote for Bush or Perry and illegals voting illegally for democrats.

So the issue will never REALLY get cleaned up.Just like campaign finance reform,term limits,lobbiests,big gov,the senate and house getting COLA payraises while the country suffers, and so on and so on.

I also am sick of the talking point thay all use...

REIN in government spending,Rein i the EPA.

REIN IN? How about DISMANTLE?Sorry but I am old enough to have seen too many elections of IMMIGRATION REFORM BS talking POINTS and then everybody forgets about it after they are on the POTUS throne.

I really don't see any sense my continuing a discussion with you. I feel as though we inhabit different realities. Wong Kim Ark talks extensively about being grounded in the 14th amendment, Plyer does, as well (and Plyler involves persons in the country illegally), yet you are reading the cases as though the 14th has been held, by SCOTUS, to not apply to a person in the country illegally.

They could NOT become citizens, as a matter of treaty with China, and of US federal law at the time. Below from Wong Kim Ark, previously linked for you.

It is true that Chinese persons born in China cannot be naturalized, like other aliens, by proceedings under the naturalization laws. But this is for want of any statute or treaty authorizing or permitting such naturalization, as will appear by tracing the history of the statutes, treaties and decisions upon that subject ...

Those statutes were held, by the Circuit Court of the United States in California, not to embrace Chinese aliens. In re Ah Yup (1878), 5 Sawyer 155. And by the act of May 6, 1882, c. 126, S: 14, it was expressly enacted that "hereafter no state court or court of the United States shall admit Chinese to citizenship." 22 Stat. 61.

In Fong Yue Ting v. United States (1893), above cited, this court said:

Chinese persons not born in this country have never been recognized as citizens of the United States, nor authorized to become such under the naturalization laws.

The Convention between the United States and China of 1894 provided that

Chinese laborers or Chinese of any other class, either permanently or temporarily residing in the United States, shall have for the protection of their persons and property all rights that are given by the laws of the United States to citizens of the most favored nation, excepting the right to become naturalized citizens.
28 Stat. 111. And it has since been decided, by the same judge who held this appellee to be a citizen of the United States by virtue of his birth therein, that a native of China of the Mongolian race could not be admitted to citizenship under the naturalization laws. In re Gee Hop (1895), 71 Fed.Rep. 274.

I am so sick of that talk to the feds crap. He was governor for 10 years!!! He was governor when the Republicans had ALL THREE PARTS OF GOVERNMENT and he did NOTHING. I don’t give a dang what you say, he did not go on Fox News every night while we had three branches of government complaining about the feds not doing anything. He did not have numerous press conferences calling Bush out. Nope. He did NOTHING!!!!! Arizona and Alabama are doing the right thing....will they get everything they want? No, but at least they are giving 110 percent effort. Perry did NOTHING for 10 years!!!!!!!!! He is 100 percent like Obama. For the next four years if he is President he will blame Obama for all the problems just like Obama is doing this with Bush.....Perry has started already. He is a stinky candidate and I KNEW it from the beginning.

By the way, what does that work out to per student? What is 400 million dollars divided by 16,000 illegal students?

25,000 per student. He is NOT serious about immigration. 400 million for a state like Texas is chump change. Sheesh...that is about one day of oil revenue. he is such a fraud. I am just proud of myself to have seen if the MINUTE he announced and I read about him. The fact that people here support him is so sad.

Don’t play silly! If you pay Texas taxes for a year, you get the tuition break. The illegals must pay them 3 years.

Look I agree this is nonsense, but a dem controlled lagislature passed it in 2001 veto proof. Until we can figure out how to change it neither me nor Perry can do a damn thing about it.

I hope this new Alabama thing takes hold and we can get a Fed Gov that will enforce our immigration laws. But that ain’t now.

They work toward their U.S. citizenship as part of their in-state tuition. They're basically stateless people -- brought to the U.S., raised here, educated here and roots here.

No, they are here illegally which means they are criminals, not "stateless people".

No, you don't. If I go to Texas and establish residence, sure, but if I go to Texas to attend school THAT TIME DOES NOT COUNT FOR THIS PURPOSE.

Virtually every state has that law ~ California is the only exception.

It is literally the life and death of this nation.

Illegals drain resources

Illegals close our hospitals

Illegals use our emergency rooms as their “free doctor’s office”

Illegals fail to assimilate

Illegals bring more crime and lawlessness

Illegals bring diseases like tuberculosis

Illegals water down the electorate, guaranteeing Democrat domination of elections

Illegals do not recognize our laws and borders

Illegals take our jobs

Illegals send our money back to Mexico

Terrorists cross our borders

Drugs cross our borders

The Mexican Army crosses our borders

Drug Gangs cross our borders

etc. etc.

When I read the above, I was furious at you. Don't you know that the State of Texas has spent $400 million of its own money trying to control its border. You still don't get my logic that said, "The solution to all your listed sins is to seal the border." Has something blinded you ability to reason? Border security is a federal responsibility, but because Washington has abdicated it’s most important constitutional duty of protecting and defending American citizens, Texas has been forced to step in to fill the gap. And you shift the blame to Governor Perry and the people of Texas. SHAME ON YOU!

With lies and distortions that you spew, it is apparent that you really want Obama to be reelected.
