They can apply for a permanent residency which makes them legal (not a us citizen).

The in-state tuition law states that they have to apply for a permanent residency in the US, be in a Texas school for at least 3 years up to graduating high school and they have to pay the tuition.

The sections of Texas Education Code are 54.053(3) and 54.052(a)(3).

There is no requirement to apply for permanent residency or citizenship.

There is no requirement to be in a Texas school for 3 years - the requirement is to prove residence.

Thank Mom, but I have read HB 1403 and am aware that seeking 'legal status' is required. It would seem Perry has no idea what is in the bill he signed as he himself has said the ILLEGAL aliens wanting instate tuition must be pursuing citizenship in the state of Texas.

“In the state of Texas, if you've been in the state of Texas for three years, if you're working towards your college degree, and if you are working and pursuing citizenship in the state of Texas, you pay in-state tuition there,” said Perry.

As for my post, I was responding to a similar erroneous statement by this poster asserting the same line that the ILLEGAL aliens must be seeking "citizenship".

I see this lie repeated many times at FR but understand that if Perry himself says it his followers are likely to follow suit.
