ATF Death Watch 75: ATF-Enabled Indiana Guns Went to Chicago Gangs

I just got off the blower with Brent R. Weil [above] 0f Kightlinger and Gray, LLP. The Evansville, Indiana lawyer represents the [as yet unnamed] gun store that sold firearms to ATF-enabled straw purchasers. “The ATF told my client to let the sales go through,” Mr. Weil told TTAG. “He later told me that the guns went to Chicago gangs.” In one case, a straw purchaser failed to pass the FBI’s NICS [National Instant Check System] background check . . .

The dealer called an ATF agent in the parking lot; the agent told the dealer to let the sale go through. The ATF arrested the so-called straw purchaser after he walked out the door. In every other instance, however, the ATF did not apprehend the buyers immediately after purchase.

In one case, a buyer and his associate left the store and smashed their vehicle into a police car on their way out. (Seriously.) The driver was charged with the traffic incident, but allowed to keep the guns and proceed. Whether or not the ATF kept tabs on the guns after that, or if guns were used in subsequent crimes, is unknown.

Mr. Weil also threw some cold water on the theory that Mexican cartel members in Indiana purchased the guns with the ATF’s blessing as part of an anti-Los Zetas quid pro quo. “The buyers were black and caucasian,” Weil said. Also, the gun store in question initiated the contact with the ATF.

The new information doesn’t rule out the possibility that the Indiana gun store “sting” involved criminals affiliated with the Sinaloa or La Familia cartels (whom the ATF armed during Operation Fast and Furious). But that possibility seems a whole lot less likely.

Nonetheless, the Indiana intel reveals that the ATF was allowing known criminals to purchase firearms. The crucial question: did they lose track of the guns accidentally on purpose, as they did during Operation Fast and Furious?

And if the guns purchased in Evansville ended up in The Windy City, the ATF’s heir apparent—Chi-town Bureau Chief Andrew Traver—must have known about the policy. What did Andy know and when did he know it?

As Ralph points out below, we’re still left wondering about the scope, scale and final destination of all ATF-enabled firearms. How many vicious thugs bought firearms with the ATF’s help? How many of those were recovered and/or recovered from crime scenes?

Meanwhile, rumors are swirling that the Carson City killer used an ATF-enabled AK-47 during his murderous rampage. The attacker, Eduardo Sencion, was Mexican-born (with an American passport) with no criminal record.

There’s no firm evidence establishing linking Sencion with the ATF. The fact that anyone would even think of that possibility reveals the corrosive effect of the ATF on the public’s respect for the federal government and the primacy of the rule of law. It’s yet another reason to deep-six the ATF—after we find out what they’ve been doing with our tax money.

We know something like this (ATF sanctions of gunwalking) happened in Texas as well. The question is how pervasive is this? Gun store owners have a built in incentive to remain quiet, as their livelyhood depends on an ATF issued license. Licenses are part of the overall progressive regulatory scheme. Their societal cost seems to be more than their benefit, which is highly debatable.

The concept that the government could or should only “allow” certain people to buy guns stands the very concept of American jurisprudence on its head. It presumes that the government knows all, controls all, and should be doing so. It is wrong and ineffective. It is the opposite of preventing criminals from possessing guns.

It is crazy to set up a huge expensive bureaucratic system, require everyone to jump though hoops and prove that they are *not* criminals in order to try, ineffectively, to prevent the few individuals who are not responsible, from having legal access to guns. This is a failed paradigm, and it should be abandoned. To accept the idea that the all gun sales should be monitored by the government, and only allowed to those it deems satisfactory is fundamentally wrong.

The entire idea of the enterprise has always been the death of a thousand cuts, where the restrictions on who can buy, and where, and how and what are continually increased until the number of gun owners is reduced to political insignificance.

The Carson City shooting and shooter bothers me no end. They keep saying it wasn’t terrorism. Well then, what the hell was it? WHERE did that AK come from? WHY did a Mexican national have an AMERICAN passport? What was he doing here? It stinks. Badly.

Don’t know how things work in Penn. but here in Florida you can get near any kind of gun you care to have.
My son actually deals directly with a Russian military front
to purchase his ass kicking rifles and ammo directly from them. Rifles Sent to a licenced dealer here in Florida, ammo comes directly to the house,.
You ought to see the U.P.S. driver when he deliverrs a thousand or two rounds of Russian made and stamped ammo.
Ak74, saiga semi auto 12Ga,old Mosin, and of course a dragonov.
Personally I like rugar, Kimber and marlin, and of course an 870 shotgun.

One thing is certain. These incidents of ATF looking the other way during gun sales to straw purchasers and people who are not allowed to buy guns legallay IS NO COINCIDENCE.

It has to be a planned operation coming from the top.The top is Resident Obama.

The whole time he is railing against gun shows he is encouraging licensed business’s to break the law.Not really encouraging them, but ORDERING them to break the law.

Working under the radar as he told Mrs. Brady.

Meanwhile an honest gun purchaser is given the 3rd. degree and made to wait for his purchase.

As I said this isn’t coincidence, there is a deliberate act going on here, and it is coming from the White House.

There's just one thing that strikes me odd about this. To wit: Evansville, IN is 300+ miles away from Chicago and it's a 6 hour drive. As such there's scores of Gun Shops in Indiana a lot closer to Chicago, like right over the border. So why go all that way South??

Plus if the straw buyer was an IL Resident, he or she would still have to show a valid IL FOID Card. And if they were an Indiana resident, again -- buying closer to Chicago would make more sense.

That is all.
(the BATF being involved does NOT surprise me or seem odd).

In my opinion, this is too widespread to be a “botched sting” operation to enact gun control.

They're arming up.

This looks to be a repeat of what Clinton's buddies the Chinese were doing when they got caught supplying weapons to the gangs in 1996.

Clinton was not leaving the WH in 1996.

Sounds like a certain “Community organizer” and his appointed toadies are preparing for his return to Chicago in January 2013.
