NATO commanders who authorized the Libya bombing campaign should be held accountable to international law and hauled before the world court for civilian deaths, Rep. Dennis Kucinich (D-Ohio) said Tuesday.
NATOs top commanders may have acted under color of international law, but they are not exempt from international law, Kucinich said in a statement released by his office. If members of the Qadhafi regime are to be held accountable, NATOs top commanders must also be held accountable through the International Criminal Court for all civilian deaths resulting from bombing. Otherwise, we will have witnessed the triumph of a new international gangsterism.
Kucinich, who in March suggested President Barack Obamas authorizing of airstrikes on Libya were an impeachable offense and sponsored a July measure to defund the military effort there, criticized what he called an evolving rationale for the NATO offensive.
The seven-term Cleveland congressman released his statement just as forces loyal to Qadhafi appeared to have abandoned their defense of his heavily fortified Tripoli compound.

Kucinich forgets that Libya is a pariah state ~ if they weren’t already a brutal desert they’d deserve having their country turned into one.

Dennis Kucinich is a leftist loon of the first order. Qadhafi’s generals murdered people to retain his hold on power. NATO generals - acting on orders from their duly elected government - authorized air strikes on Libya to help Libyan rebels defeat the Qadhafi regime. Unfortunately and, frankly, inevitably, civilians were killed. For the little congressman from Ohio to make a legal and/or moral equation of the two is classic leftist thinking based on the fact that liberals such as Dennis Kucinich cannot distinguish between right and wrong. This demand by Kucinich for criminal prosecution of NATO generals will annoy many but go nowhere because Libya is Obama’s war.

All the years of liberals screaming that Bush got us into illegal wars when in fact they were voted on by congress. This president did exactly what they say Bush did, he went into a war without the blessing of congress. Therefor it is Obama and the liberals who allowed this illegal war.

is not quite correct. US generals were NOT acting on orders from the part of the US government authorized to declare war. The person who ordered the US involvement in this war — the president — does NOT have the power to initiate a war, except in a manner delegated to him by the war powers act. The president, and the generals who followed his orders, and the rest of the US military personnel involved in the attack on Libya, have thus commandeered US military assets without proper authorization.
I think there’s therefore a pretty good argument that everyone involved has committed a war crime. The crime would not be against the Libyans, but against the US and its constitution. In such a case, multiple trials would be in order.
Ah, the War Powers Act. Thanks for the reminder. I assume the Obama administration sees that as a 'technicality'. However, you have a point. But we both know that this was Obama's war and congressional Republicans have no stomach for this kind of confrontation based on constitutional issues. Especially if the result could end up with 'everyone involved' being labeled a 'war criminal' it can almost be guaranteed that absolutely nothing will happen. Nothing. The 'good guys' won and for the moment, that's all that matters to anyone. What Libya may look like a year from now is something few wish to contemplate in any depth because the future is unknowable. Today, the important thing for the media is that Obama has another 'foreign policy victory' (killing bin Laden being the only other) and all is right with the world. Constitution? To quote the former Speaker of the House, Nancy Pelosi (when asked if the hated ObamaCare bill was constitutional): "Are you serious?"
