Gov. Nikki Haley signed a new bill known as the Copper Theft Bill that makes several changes to the current law regarding the sale and purchase of copper.
Under the new law, anyone who intends to transport and sell any non-ferrous metal, including copper and catalytic converters, to a scrap metal dealer must first obtain a free permit from the sheriff in the county where the seller lives.
There are two types of permits available to the public: one is a one-year permit and the other is a 48-hour permit.
To obtain the one-year permit, a person must submit an application to the sheriff's office in the county where they live. Upon approval of the application, the sheriff will issue the applicant a permit which will allow them to transport and sell non-ferrous metals to a recycler.
To obtain a 48-hour permit, a person must call the sheriff in the town where they live. The person making the phone call will then be given a permit number good for the transporting and sale of non-ferrous metals for 48 hours.
Non-residents of the state of South Carolina may obtain either permit from the Sheriff of the County where the scrap metal dealer is located.
Any person or business that intends to purchase copper or catalytic converters must obtain a "permit to purchase" from the sheriff's office in the county where they do business. There is a $200 fee for the "permit to purchase" and must be renewed every two years.
The new law goes into effect August 17, 2011.

I imagine you’ll start seeing a huge queue of copper thieves lined up to get these permits.
Under this law going to the liquor store / grocery store and bringing home a 6 pack or 12 pack of anything would be criminalized because the cans are aluminum (non-ferrous). I transport non ferrous metal every single day in my cervical spine (it is in the form of a titanium plate and six titanium screws).
There have to be some reasonable exemptions to this law - they really can’t be this stupid can they?

They don’t need any new laws. Enforce existing law. It’s illegal to steal copper or anything else. More regulations don’t fix anything.

It's the government, of course they can.
Typical governmental solution, punish and/or restrict the innocent with laws the guilty aren't going to follow anyway.
A better solution would be to allow the private use of deadly force to prevent copper thieves from making off with their booty.
Damn, man you cannot sell metal without the permit, are you going to buy beer and pour it out so you can sell the cans. This is to stop, the metal dealer from saying I have no ideal who the seller was.
You are so right about that. Sentence the next five copper thieves you catch to 39 yrs. with no possibility of parole and the problem will begin to go away.
Just like the Chicago Mob lined up to get tax stamps after the National Firearms Act passed.

I honestly can't stand to see this wonderful country brought down. I don't hate many people, but my dislike and distrust of Barry Obama verges on hatred. Not like me to harbor these negative emotions....and that is another reason I don't like him!
This law forces scrap dealers to report, that is the intention.
But its unworkable, for two reasons. 1. The law doesn’t stop thieves from transporting the stolen metal across state lines. 2. Countries, like China, who are the main driving force behind these metal thefts, are not buying the metal on the open market. They are paying professional gangs to steal the metal and deliver it to Chinese agents, who transport the stuff by the ton onto huge cargo ships to be shipped to China, where it gets melted down to useful things.
Law enforcement is struggling with this one. Copper ripped from its source has no serial number and no way of indicating where it came from. Scrap dealers are able to buy it with little or no fear of being convicted of dealing in stolen property.
That is why the occasional thief who gets electrocuted appeals to my sense of justice. Someone is correct we need to elevate the punishment of these crimes. The penalties should be a function of the damage caused by their theft not the value of what they stole.
These crooks are evil. If someone robs a bank they get a value equal to what they take. When someone rips the copper out of an air conditioning unit, they get about $50 but cause a $1500 loss to the person they stole from.

Looking at the bright side I'll still be able to legally steal your car and turn it into one of these, as long as I remember to rip out the wiring harness and drop the catalytic converter.
I just love that we have Hayley and Jindal as southern govs. It must really, really make the heads of the Dems explode! Conservatives are the ones that don't care about gender or race...and we keep proving it all the time.

Exactly, YET this simple fact eludes the Law & Order types time and again. Never can they explain exactly how more laws will cut crime. I think its mostly an out to keep from really thinking. Here when I sell copper I must give my thumb print. It used to be Id have to do the same when purchasing a gun. They eventually (after many many yrs) figured out that was a wasted exercise. In all that time the finger print was NEVER used to make a conviction or arrest. So, building on a past failure they’re erecting a new farce. We have become a stupid people demanding whats not in our best interest.
