2 N.J. teens labeled sex offenders for life after 'horseplay' incident

SOMERSET COUNTY — Call it bullying or call it horseplay. Either way, a state appellate court panel says roughhousing with a sexual connotation by a pair of 14-year-old Somerset County boys was a crime that requires them to register as sex offenders for the rest of their lives.
In a decision handed down Monday, the three-judge panel acknowledged the severity of its decision, but said it was bound to uphold the law.
"We are keenly aware that our decision may have profound lifelong ramifications for these two boys as well as others similarly situated," Judge Jose Fuentes wrote.
One of the boys, whose case went to trial, said he had sat on the faces of a pair of 12-year-old schoolmates with his bare buttocks in November 2008 "cause I thought it was funny and I was trying to get my friends to laugh," he told a family court judge.
But an act is considered criminal sexual contact if it is done for sexual gratification or to degrade or humiliate the victim, and punishable by lifetime registration — even for juveniles — under Megan’s Law, which requires a person convicted of a sex crime against a child to notify police of changes of address or employment.

When I was that age this type of behavior would of been considered homosexual in nature. Nobody would do this unless they were a pervert. When I read some of the comments from people who see this as nothing, I wonder about them.
Lifetime registration requirements can be overturned by the state Attorney General.

For instance...I'm a smaller guy...a white "redkneck" looking guy. Was out the shop door having a cig...and a crew from the Atlanta jail was out picking up trash on the road.

And the flip side of this is that if the boy put his naked butt on a girl’s face, no one would be laughing it off.
Remember, the more people ‘we’ can charge with ‘sex crimes’, spit on the sidewalk say 3 times and get charged as a repeat offender and they invoke the 3 strike rule, just leads to the fewer people that will be able to own a weapon.
10 yo boy brings toy soldier with rifle and bayonet to school, you suspend him for a weapon in school, put it in his ‘permanent file’ and when he goes to apply for anything 10 years later, they find the ‘suspended from school because of a weapon’, we have built another felon.
Definitely convinced it is a convoluted, long time plan along with the demasculinization of us.
When I first ‘read’ the story, it appeared that the doer and doee were suspended, went back and reread and see there were 2 doers or maybe 1 and an aide, but 2 dooees.
Kid needs a good arse whupping, maybe suspended AND a real stretch here- - maybe some time in juvey BUT definitely not be labeled a sex offender for life...

Simple. Early on, brand an ever-increasing number of impressionable teenage boys as lifetime sexual deviants, by any means possible.
Increase their the chances to become homosexual as adults.
So two wrongs make a right? Just because a horses ass Judge decides an immigrant in America cab ignore our laws as long as he follows his doesn’t make it right.
It seems now that anytime someone commits a crime, and the facts state that the 14yr olds commited a crime, people crawl out the woodwork to make excuses. This is true for Liberals and now Conservatives as well. These young dirtbags (who become adult dirtbags) commited a sex crime and now it is time to pay the piper. I cannot believe all the low lives who say no big deal. Or the ones who say they did the same thing, so no big deal. The main problem with the country today is there are way too many low lives amongst us.
This behavior is more bullying, humiliating and showing off behavior, apparently with any audience, making reality of the ancient “kiss my ass” insult. I doubt it’s sexual if these kids are straight. It deserves a pretty severe juvenile punishment, but shouldn’t be put in a sex offender registry.
Exactly so. There is the letter of the law and the spirit of the law. The latter is frequently ignored.

The judges don't have discretion anymore thanks to the knee-jerk laws passed by yahoos. The judge said as much here. What discretion is left belongs to the fascist prosecutor. I'm sure he'll tout this as a great victory for "the children"!
I agree this is not horseplay. Its obscene and unacceptable. For a kid to think this is fine, as an adult would be doing worse things...

Disgusting. But, this is what goes on in gym class, summer camp, college hazing, .... and God knows what else in Basic Training. It's awful. But it is not a sex crime!!!!!!!
The big game when I was in High School was to sneak up behind someone in gym class and pull their shorts to their ankles.
Probably a crime against nature now.
How about the old fashion reform school for delinquents...that kid is not going to turn into an angel with age....
