There’s no legal basis for this requirement. None. The reporting requirements for multiple handguns is explicitly spelled out by an act of Congress.
Presumably the NRA will immediately sue Obama in multiple Federal courts on behalf of hundreds of gun dealers in the affected states.
Personally I’d like to see an immediate injunction filed to stop ANY further progress on this policy...
A lawsuit takes time and money...Something the NRA and the rest of us do NOT need to spend to stop this BS...
The bottom line is this...
So flippin’ what if I buy a few long guns in a month...That is NOT a crime, nor is it anyones frappin’ business what I do...Much less a government agency/department developing reports on my private aquisitions...
But my opposistion would brand me immediately as some sort of subversive person in their opinion...Which is another thing I don’t care much for...
Are you sure? Congress will often delegate broad authority to write regulations to agencies charged with carrying out legislation.
The ultimate authority for gun control legislation is the New Deal Commerce Clause. You remember that, right? You were demanding the Administration enforce another regulation based on the same expansive view of that Clause here .
You can't have it both ways. Do you support the original Commerce Clause or the New Deal Commerce Clause?
There is no legal requirment, but if you are a FFL holder you will comply. They can shut you down for less, and you will not get the case heard.
