If COPS don’t have the right to check their status, how would they know when to inform them about consular assistance?

Humberto Leal Jr. has lived in Texas since he was 2 years old. If he has any family in Mexico at all now he has probably never had any contact with them. Someone please ask Jug Ears and Cankles how this is a serious foreign policy matter.

the failure of Texas authorities to grant the 38-year-old Leal -- who has lived in the United States since he was 2 years old -- access to a Mexican consular official at the time of his arrest.

This illegal was here since he was two years old. Wouldn't that make him a DREAM candidate?

Additionally, this Vienna Treaty issue doesn't apply because the incriminating statements he made were while he was not in custody. You don't have to alert the consulate until the person is arrested.

Good point. It’s darned if you do, darned if you don’t. Had he been informed of his “rights,” it’d be racial profiling.
