Felony hate crime allegations were dismissed Wednesday against two men accused of assaulting and robbing a transgender woman near San Franciscos 16th Street BART station in April, but the pair were ordered by a judge to stand trial on other charges in the case.
Lionel Jackson, 32, and Maurice Perry, 37, are accused of attacking the woman on April 1 outside the BART station at the intersection of Mission and 16th streets and taking her smartphone.
When she demanded the phone back, the pair allegedly punched her, knocking her to the ground, where they also allegedly kicked her, police said.
Alexandra Byerly, who was passing out condoms nearby as part of an HIV prevention campaign, testified on Monday in the preliminary hearing that as the suspects were fleeing the attack, one of them said, Oh, I hate men dressed up as women.
The two men were arrested shortly after the theft.

Even the Sick Freako judge knew the hearsay comment allegedly made after the mugging could not prove a “hate crime” (as if an ordinary mugging were a love crime).
If the criminal indictment reads anything like this report these guys will get off scott free. “No your honor, I never attacked any woman that night” will be a perfectly true statement. Kinda like when the cops get the make and model of your car wrong on a ticket.
Reports of people who have made a lifestyle of hiding their birth gender ought to refer to them as “it.” It’s difficult otherwise to suss out whether birth gender or assumed gender is intended.
To do it “right” the indictment will need to describe both the victim’s birth gender and assumed gender.

Well they pretty much have to considering California state law. As illustrated by the Chaz Bono business, you can legally claim gender based on a doctor’s note saying that’s what you are. Anatomy being irrelevant to the discussion. Therefore Chaz still with a vagina is a man and has the legal state certificates to prove it.
In “Alice Through the Looking Glass” the Queen of Hearts said she wasn’t confined by any dictionary. Words meant what she intended them to mean, no more and no less. The Queen of Hearts principle seems to apply here as well. In that climate it’s not in the newspaper’s interest to quibble.
